Mechanic’s (Construction) Lien Law

Florida has strict deadlines that govern construction liens, commonly known in Florida as mechanic’s liens. If you intend to file a mechanic’s lien to help ensure you receive payment, you have only 90 days from substantial completion of the work to file your mechanic’s lien. You cannot rely on punch work to extend this deadline. You have 45 days from the day you first start the work or deliver materials to the job to file your Notice to Owner if you are not in direct contact with the owner.

The mechanic’s lien is valid for one year from the date of recording. If a lawsuit is not filed to foreclose the Claim of Lien within that year, the mechanic’s lien is void. Therefore, it is critical to contact us as soon as possible because Florida mechanic’s lien statutes are strictly construed by the courts. Miss a deadline and you are out of luck.
